AB 1203-CN1 is a California bill that was signed into law on January 1, 2020, and requires certain employers to provide their workers with sexual harassment prevention training on a biennial basis. The bill is intended to help prevent sexual harassment in the workplace and ensure that employees are aware of their rights and responsibilities.

Under the bill, employers with five or more employees, including temporary or seasonal employees, are required to provide at least two hours of sexual harassment prevention training to all supervisory and non-supervisory employees in California. The training must cover specified topics, including:

  • The definition of sexual harassment under state and federal law
  • The types of conduct that constitute sexual harassment
  • The remedies available to victims of sexual harassment
  • Strategies to prevent harassment
  • The complaint process available to employees

The training must be provided by trainers or educators with knowledge and expertise in the prevention of harassment, discrimination, and retaliation. The bill also requires the Department of Fair Employment and Housing to develop and post training materials on its website for employers to use.

Employers are required to provide sexual harassment prevention training within six months of an employee’s assumption of either a supervisory or non-supervisory position. Thereafter, training must be provided once every two years.
